Paving a drive in Spain: permits, town halls and the vado

In shortIn Andalusia, minor works that need no project generally go through a responsible declaration under the LISTA law, but each town hall's ordinance decides which procedure applies to your driveway. Anything that touches the public pavement, such as a dropped kerb or a vado for vehicle access, needs separate municipal authorisation. In a community of owners, work on common elements also needs a meeting resolution. The owner files the paperwork; we supply a clear description and quote.

Do I need planning permission for a block-paved driveway in Spain?

Usually you need some form of municipal paperwork, but it is rarely what British owners think of as planning permission. In Andalusia, Law 7/2021 (LISTA), article 138.1.a), places minor works of limited constructive scope that do not need a project under a declaración responsable, a responsible declaration in which the owner states the works and starts them under their own responsibility. Its regulation is Decree 550/2022.

That is the general frame. Which procedure applies to a specific driveway, whether a responsible declaration, a licence or no paperwork at all, is set by each town hall in its own ordinance. Two neighbouring municipalities on the coast can treat the same job differently, so the answer always comes back to the town hall where the property is registered.

Spanish terms you will meet: licencia de obra menor (minor works licence, still used in some contexts), declaración responsable (responsible declaration), actos no sujetos a licencia (acts not subject to licence) and tasa and ICIO (the municipal fee and the construction tax). How each is calculated is set by the relevant municipal ordinance, which is why the town hall usually asks to see the budget of the work.

How does Málaga city handle minor paving works?

Málaga City Council's planning office (Gerencia de Urbanismo) reported in 2021 more than 40 types of works handled by responsible declaration and 22 types exempt from both licence and declaration. These are listed on its website under 'actos no sujetos a licencia'. Whether a specific paving job is on that list has to be checked case by case against the current list, or by asking the Gerencia directly.

In practice, the description of the job matters: replacing an existing paved surface like for like is a different case from creating a new hard-standing on a former garden, or from altering levels at the boundary. The clearer the description, the easier it is for the planning office to place it in the right category.

What about Marbella, Mijas, Estepona and other towns?

For Marbella, Estepona, Fuengirola, Benalmádena, Torremolinos, Mijas and the other municipalities in the province, the procedure for a given outdoor paving job is set by the municipal ordinance in force, so the town hall is the place to confirm it. We do not publish a town-by-town list here, because ordinances change and a wrong summary would do more harm than none.

  • Check the planning section of the town hall website, or its electronic office, for the current model forms.
  • Ask whether your job is a responsible declaration, a licence or exempt, describing it in plain terms.
  • If you use a gestor, an architect or a property manager, they can file it on your behalf.
  • Keep the stamped or electronic receipt, because you may be asked for it during or after the works.
  • In a community of owners, check the community statutes as well as the town hall rules.

The pillar site has a wider overview of the rules in its guide to permits and rules for paving, including waste and safety obligations.

What is a vado and when do I need one?

A vado is a municipal authorisation for vehicles to cross the public pavement into a property, usually marked with a numbered sign and often linked to a dropped kerb. If the job touches the public pavement or the kerb drop for a vehicle crossing, separate municipal authorisation is needed, and its conditions and fees are those of your town hall's ordinance.

This matters for driveways because the most natural finishing point for new paving, the gate line, sits right next to public space. Paving up to your boundary is your private work; lowering the kerb, re-paving the pavement in front of the gate or changing its levels is public space and is handled by the town hall or under its authorisation.

We build to the boundary and coordinate levels so the new drive meets the pavement cleanly. If you are applying for a vado or a kerb drop, we can give you the description and dimensions of the private works to attach. We do not apply on your behalf and we do not alter the public pavement without the authorisation in hand.

Do I need permission from the community of owners?

If the paving is on a common element, such as a shared access road, a communal car park or the entrance of an urbanización, yes. Spain's Horizontal Property Law (Ley 49/1960) requires a resolution of the owners' meeting under the majority rules of article 17; ask the community administrator which majority applies to the job in question.

Even on a private plot inside a community, the statutes may regulate visible exterior finishes or access points. If your drive alters the common elements, for example by opening a new entrance from a shared road, contact your community administrator early. The process is explained in our guide for communities of owners and on our car parks and communities page.

What other rules apply during the works?

Two sets of rules apply to almost every paving job: waste and site safety. Construction and demolition waste is governed by Royal Decree 105/2008 and Law 7/2022, which treats rubble from minor domestic building and repair works as household waste under municipal responsibility. Lifting an old drive therefore involves arranging proper disposal of concrete and soil.

Typical European List of Waste codes when lifting paving are 17 01 01 (concrete), 17 01 07 (mixtures of concrete, bricks, tiles and ceramics without hazardous substances) and 17 05 04 (soil and stones other than 17 05 03). Health and safety on site follows Royal Decree 1627/1997, which sets minimum provisions for construction works with or without a project.

Skips or containers placed on the public road usually need their own municipal permission too, according to each town hall's rules, and who requests it is agreed in the quote. On narrow urbanización roads, delivery of materials and removal of rubble are planned so that neighbours keep access, which is often a condition set by the community rather than the town hall.

For owners who live abroad, we keep the paperwork side simple: the quote describes the works in plain terms, we confirm dates only once you tell us the filing is done, and we send photos at the key stages so you can show progress to an administrator or a gestor if they ask.

Who does what: the owner, the town hall and the contractor?

The owner, or someone they appoint, files the declaration or licence application and pays any municipal fee. The town hall decides the procedure and any conditions. We, as the contractor, execute the paving works and provide the written description and quote that the paperwork usually needs. We do not draft technical projects or sign as the technician.

That lets us shape the quote so it serves as the description you need for the town hall, and you can compare it with the details on driveway block paving or garage entrances.

Frequently asked questions

Is a responsible declaration the same as a licence?

No. With a responsible declaration the owner states the works and their compliance and can generally start under their own responsibility, subject to later checks. A licence is a prior authorisation granted by the town hall. Which one applies to your driveway is set by the municipal ordinance.

Which law covers minor works in Andalusia?

Law 7/2021 of 1 December (LISTA), article 138.1.a), places minor works of limited constructive scope that need no project under a responsible declaration. Its general regulation is Decree 550/2022. Each town hall's ordinance then decides which procedure applies to a specific job.

Can you apply for the permit on my behalf?

We do not file applications or act as the technician. We provide a clear written description and quote that you, a gestor or your administrator can attach. Many foreign owners use a gestor or their property manager to file the paperwork, which works well alongside our documentation.

Do I need a vado just to pave my own drive?

Not necessarily. The vado concerns vehicle access across the public pavement. Paving inside your boundary is a separate matter. If you want to drop the kerb, alter the pavement or obtain a reserved access, that needs municipal authorisation, and your town hall can tell you what the application involves.

Is replacing an existing paved drive treated like a new one?

Often not, but it depends on the ordinance. Replacing a surface like for like tends to be simpler than creating new hard-standing or changing levels at the boundary. Describe the job plainly to the town hall, including whether the area was already paved.

How is the municipal fee calculated?

Town halls commonly charge a fee and the construction tax (ICIO), and the ordinance defines what the charge is based on, which is one reason they ask for a quote. Rates and rules are set locally and change, so check the current ordinance of your town hall rather than relying on a general figure.

Does Málaga city publish a list of works that need no licence?

Yes. Its planning office published in 2021 a list of more than 40 types of works handled by responsible declaration and 22 types exempt from both, under 'actos no sujetos a licencia' on its website. Whether your paving job is included is best confirmed with the planning office for your specific case.

What happens to the old paving and rubble?

It is removed and taken to an authorised facility. Under Law 7/2022, rubble from minor domestic works is treated as household waste under municipal responsibility, and typical codes include 17 01 01 for concrete and 17 05 04 for soil and stones. Disposal is included as an item in our quote.

Do I need community approval for paving inside my own plot?

Not usually for purely private work, but check the community statutes, which may regulate visible exterior finishes. If the job alters common elements, such as a shared road or a new entrance from it, a meeting resolution under the Horizontal Property Law is needed.

Can work start before the paperwork is filed?

We prefer not to, and we will not touch the public pavement without the authorisation. For private works, we agree a start date once you confirm the declaration has been filed or the licence granted, or that the town hall has told you no paperwork is needed for your job.
